So when Rochester's wife goes mad, rather than ship her off to one of those places, he keeps her locked in an upstairs room of his mansion. This is an act of humanity, not an act of cruelty. However, he cannot legally marry again, bigamy and polygamy both being illegal in Great Britain and all other Christian cultures.
